Senator Tina Polsky and Representative Dan Daley have refiled legislation aimed at closing a loophole in Florida’s gun laws ahead of the 2026 Legislative Session.
The proposals, SB 88 and HB 41 — also known as “Jaime’s Law” — require background checks for all ammunition purchases. The measure is named after 14-year-old Jaime Guttenberg, who was killed in the 2018 Marjory Stoneman Douglas High School shooting in Parkland.
Under current law, individuals prohibited from owning firearms are also prohibited from buying ammunition, but no background check is required at the point of sale. Advocates say this gap allows dangerous individuals to obtain ammunition despite restrictions.
“We have a responsibility to do everything in our power to prevent tragedies like the one at Marjory Stoneman Douglas from happening again. Requiring background checks for ammunition is a logical, life-saving measure that aligns with existing firearm laws. Jaime’s Law is about closing a dangerous gap and making sure those who are prohibited from owning a gun can’t easily stockpile ammunition instead,” said Senator Tina Polsky.
Representative Dan Daley, a Coral Springs Democrat and graduate of Marjory Stoneman Douglas, said the bill remains a personal priority.
“As a graduate of Marjory Stoneman Douglas High School, this issue remains deeply personal to me. Nearly seven years since the MSD tragedy, I’ve fought to advance Jaime’s Law every legislative session because it’s a commonsense step that can save lives. Background checks on ammunition just make sense, and with over 20 states already taking action, it’s time for Florida to do the same. We can’t keep waiting for the next tragedy to act,” Daley said.
If passed, Jaime’s Law would bring Florida in line with more than 20 other states that already require background checks on ammunition sales.
