In a move towards greater transparency in real estate transactions, Florida has enacted a new law requiring sellers to disclose flood history to potential buyers.
This week, the governor signed into law House Bill 1049—Flood Disclosure in the Sale of Real Property, sponsored by Rep. Christine Hunschofsky (D-Parkland). Sen. Jennifer Bradley (R-Fleming Island) championed the Senate companion bill.
The newly enacted law mandates that sellers provide potential buyers of residential real estate with a comprehensive flood disclosure. This disclosure informs buyers that standard homeowner’s insurance policies do not cover flood damage, thus encouraging the purchase of flood insurance to mitigate potential risks.
It also requires sellers to disclose whether they have filed any flood-related insurance claims or received federal assistance for flood damage on the property.
“This law is about more than just property – it’s about people,” said Rep. Hunschofsky. “Transparency is pivotal to informed decision-making, especially when it comes to purchasing a home. This disclosure requirement empowers people to make informed choices, safeguarding their families and investments.”
The legislation ensures that home buyers have relevant, material information prior to the purchase of what is likely their largest individual asset, said Sen. Bradley, who added that flood history was previously not readily available to a buyer.
